General Terms and Conditions (GTC)

Scope

  1. These General Terms and Conditions (GTC) apply to all services, information, content, and offers of MGN Investment Group GmbH (hereinafter referred to as “MGN”), in particular to the use of the website, the retrieval of project documents, exposés, presentations, and all preliminary information in connection with real estate projects.
  2. These GTC shall also apply to all future services, even if no express reference is made to them again.
  3. Any deviating conditions of the user shall not apply unless MGN expressly agrees to them in writing.

General information on information and content

  1. All information contained on the website, in exposés, brochures, visualizations, newsletters, presentations, or other documents is provided solely for non-binding informational purposes.
  2. The information provided does not constitute legally binding commitments, offers in the legal sense, or any part of a purchase agreement or other contract.
  3. Information regarding projects, floor plans, areas, fittings, technical details, schedules, or prices may differ due to planning or implementation changes.
  4. The content is prepared to the best of our knowledge, but without any guarantee as to completeness, accuracy, or timeliness.
  5. Any liability for printing errors, transmission errors, typographical errors, technical problems, or incorrectly stated data is excluded.

Non-binding nature of offers / No legal entitlement

  1. All real estate properties, projects, units, visualizations, floor plans, prices, features, and availabilities shown are subject to change and non-binding.
  2. MGN expressly reserves the right to make changes due to technical, planning-related, or regulatory requirements.
  3. A legally binding contractual relationship shall arise exclusively through a purchase agreement, construction agreement, or other written agreement signed by both parties.
  4. Verbal or telephone information shall have no legally binding effect.
  5. MGN partly obtains information and documents from third parties; such information is adopted with customary care, but liability for its accuracy, completeness, and timeliness is excluded to the extent permitted by law.

Visualizations, renderings, and sample photos

  1. Images, 3D visualizations, animations, plans, and renderings are for illustrative purposes only. They may include special equipment, furnishings, color concepts, perspectives, or outdoor facilities that do not correspond to the actual scope of delivery or services.
  2. Dimensions and area specifications may be subject to construction-related or regulatory changes.
  3. Variations in colors and materials are technically possible.

Copyright and usage rights

  1. All content on the website (texts, logos, photographs, renderings, plans, graphics, videos, layouts) is protected by copyright.
  2. Any use, reproduction, editing, distribution, or storage beyond private use requires the prior written consent of MGN.
  3. Automated extraction (scraping), copying, or further processing of website content is prohibited.
  4. Violations may be prosecuted under civil and criminal law.

Disclaimer of liability

  1. MGN accepts no liability for the accuracy, completeness, timeliness, or availability of the content provided.
  2. Liability for damages — in particular material damage, financial loss, or consequential damage — is excluded unless there is intent or gross negligence.
    No liability is assumed for technical disruptions, outages, viruses, data loss, or transmission errors.
  3. Links to external websites are carefully reviewed; however, MGN assumes no responsibility for external content.
  4. Liability for slight negligence is excluded, except in cases of personal injury.

Changes to services, content, and projects

  1. MGN reserves the right to change or update at any time and without prior notice all project information, visualizations, floor plans, areas, fittings, prices, availabilities, texts, and other content.
  2. No claims whatsoever may be derived against MGN from such changes.
  3. Plan deviations, structural adjustments, or regulatory requirements leading to changes shall not entitle the user to claims for damages or rescission.

Data protection

  1. Personal data is processed exclusively in accordance with the EU General Data Protection Regulation (GDPR) and the currently applicable Privacy Policy of MGN.
  2. The Privacy Policy contains, in particular, information on the type, scope, and purpose of data processing and is available on the website at any time.
  3. Personal data will not be disclosed to third parties without voluntary consent, except where required by law.

No commission / Brokerage services

  1. The acquisition of the described real estate is commission-free directly from the developer or owner.
  2. MGN generally acts as a real estate broker; the Austrian Brokerage Act (MaklerG), the Real Estate Broker Ordinance (IMV), as well as the statutory information obligations under FAGG and VRUG shall apply.
  3. A brokerage commission shall only become due if MGN has expressly confirmed the brokerage mandate in text form.

Use of the website

  1. The website may only be used within the scope permitted by law.
  2. The following are prohibited in particular:
    1. automated extraction or copying,
    2. circumvention of technical protection measures,
    3. interference with the server structure,
    4. embedding the website in third-party frames,
    5. any commercial use without consent.
  3. Violations may be prosecuted under civil and criminal law.

Governing law and place of jurisdiction

  1. Austrian law shall apply exclusively, excluding international conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).
  2. For all disputes arising from or in connection with these GTC, the court of jurisdiction shall, to the extent permitted by law, be Villach.
  3. Mandatory consumer protection provisions under the Austrian Consumer Protection Act (KSchG) remain unaffected.

Severability clause

Should any provision of these GTC be invalid or void, this shall not affect the validity of the remaining provisions.

The invalid provision shall be replaced by a legally permissible provision that comes closest to the economic purpose of the original provision.

Right of withdrawal

Right of withdrawal from real estate transactions pursuant to Section 30a KSchG
As a consumer, you may withdraw in writing from the contract within one week if you submitted your contractual declaration on the day of the first viewing of the contractual property, and if the contractual property serves to satisfy your urgent housing need or that of a close relative, and if the contractual property is an apartment.
The withdrawal period begins with the instruction on the right of withdrawal and the delivery of a duplicate of the contractual declaration, but in any event ends one month after the first viewing.

Right of withdrawal for off-premises contracts pursuant to Section 3 KSchG and Section 11 FAGG
As a consumer, you may withdraw in writing until the contract is concluded or within 14 days thereafter if you did not submit your contractual declaration on MGN’s business premises, nor did you yourself initiate the business relationship for the conclusion of the contract with MGN, or if you submitted the contractual declaration by distance means.

The period does not begin to run until you have been provided with a document containing the name and address of MGN, the information necessary to identify the contract, as well as information on the right of withdrawal, the withdrawal period, and the procedure for exercising the right of withdrawal.

If no information on the right of withdrawal has been provided, you shall have a right of withdrawal for a period of 12 months and 14 days from the conclusion of the contract. If MGN provides the document within 12 months from the start of the period, the extended withdrawal period shall end 14 days after the time at which you receive the document. A model withdrawal form is attached for this purpose. The date of dispatch or the date of handover shall apply. The withdrawal is not subject to any specific form.

Right of withdrawal in the event of non-occurrence of essential circumstances pursuant to Section 3a KSchG
As a consumer, you may withdraw in writing from your contractual offer or from the contract within one week if the essential circumstances that induced you to enter into the contract, and which were presented by MGN as probable, have not occurred or have occurred only to a significantly lesser extent.

Essential circumstances include, in particular: the required cooperation or consent of a third party, tax advantages, public funding, or the prospect of obtaining a loan.

The withdrawal period is one week from the time the non-occurrence becomes apparent to you, provided that you have been informed of this right of withdrawal in writing. In any event, the right of withdrawal expires one month after full performance of the contract by both parties.
